ACKNOWLEDGEMENT OF RISKS The Undersigned understands that the Program and its instructional materials are designed to increase participants’ awareness of the securities markets. All investment valuation, analyses, exercises, simulations, lectures, instructional materials, and investment strategies are for the expressed goal of understanding how the market works and are not intended to be rules and investment strategies that participants should follow. Investment decisions made by course participants using actual monies should be made with extreme caution and under parental or registered investment advisor's guidance. The Undersigned also acknowledges that all investment activities are at risk of losing 100% of their investments and further agree to not hold Bentley University and its employees responsible for any losses (past, present, and future) related to personal investments. With respect to in-person participation, the Undersigned understands that there are certain dangers, hazards, and risks (foreseen and unforeseen) inherent in attending and participating in the Program, including, without limitation, risks related to use of equipment and facilities, personal safety (including risks of minor, serious or mortal personal injury) and risks of property damage.
PARTICIPANT RESPONSIBILITIES The undersigned agrees to the following:Code of Conduct: During attendance and participation in the Program, which may include travel to/from the Bentley University campus, the participant will act in a responsible manner and will abide by the instructions of any Bentley University personnel and will comply with and follow the rules and regulations of Bentley University. If the participant fails to follow the university's rules and regulations, as determined at the discretion of the Vice President of Enrollment Management or designee, the participant may be dismissed from the remainder of the Program without refund.
Online Access: Online (remote) participants are responsible for securing reliable internet access during all course times, agree to use Zoom to access the Program, and will not permit anyone not registered to view lectures or participate in instructional activities via Zoom. No refunds will be issued for missed content under any circumstances.
Intellectual Property: The Undersigned and participant agree not to make copies of or otherwise distribute the instructional materials or to record online lecture sessions. The instructional materials are the intellectual property of Bentley University and contain copyrighted materials. Any reproduction and/or distribution of the materials is a violation of copyright law, and you will be subject to legal action taken by Bentley University and its vendors.
Account Credentials: The participant will protect and keep private all Bentley-assigned login credentials and will use these credentials only for the purposes of Program activities.
Software and Data: Access to software and databases is given to participants on a temporary basis. Use of these copyrighted materials and information is for educational purposes only. Any use of these tools to conduct investment activities with real money will constitute a violation of Bentley's agreement with our data and software vendors. Bentley University and its vendors cannot be held responsible for any investment losses from using the published information obtained from these resources through the Program.
Trading Room Resources: Bentley University’s Trading Room is a sophisticated, multimillion-dollar facility, and all computers and equipment are configured for real-time data access and interaction. Tampering with software and/or hardware will be taken as evidence of hacking and subject to disciplinary and legal action. In addition to dismissal from the Program without refund, the participant and legal guardians will be legally and financially responsible for all loss and damage resulting from such tampering, which may include legal action taken by the software vendor(s) for copyright infringement and financial damages for tampering with their information databases.
Plagiarism: The Program requires participants to prepare presentations and complete case reports. The participant agrees to adhere to copyright laws for reproducing any information published or unpublished in their presentation and case analyses. The participant agrees to confirm that no copyright material published or unpublished has been used to prepare these reports without proper authorization and citation.
Diversity and Inclusion: Bentley is committed to offering a quality education to individuals of all identities. Preparing students to function in an international business environment necessitates providing a culturally diverse educational environment. A diverse student population enriches each student’s educational experience, offering the opportunity to interact with students of different races, cultures, religions, sexual orientation, gender identities/expressions, states, and countries. To this end, participants will engage in collaborative and group activities with other participants as assigned by Program staff. Residential participants acknowledge that housing assignments are made by Bentley University and will consider, but cannot guarantee, participant requests and preferences.
Alcohol, Marijuana, and other Drugs: The Program has zero tolerance for anyone engaged in the consumption of alcohol, marijuana, or other illicit drugs during Program enrollment. Violations concerning other drugs include improper use of medications prescribed for self or others. There is also a strict non-smoking policy for commuter and residential participants, which includes tobacco and electronic nicotine products. Any violations will result in dismissal from the Program without refund and notification to legal guardians. Violators may also be subject to penalties imposed by Massachusetts state law.
In consideration of the attendance and participation in the Program, and knowingly the dangers, hazards and risks (foreseen and unforeseen) of attending and participating in the Program, the Undersigned, for themselves, any other parent and the participant, understand(s) and agree(s) to RELEASE AND HOLD HARMLESS Bentley University and its current and former trustees, officers, directors, employees, attorneys, representatives and agents and waive any claim for injury and damage resulting from the participant's attendance and participation in the Program.
It is the express intent of the Undersigned that this Agreement shall bind the undersigned, any other parent/legal guardian, the participant, the participant's family, estate, heirs, administrators, personal representatives or assigns. The Undersigned acknowledges that they have read and understand this document and the RELEASE AND HOLD HARMLESS provisions. The Undersigned agrees that this Agreement shall be construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to the conflict of laws provisions thereof, and that the Commonwealth of Massachusetts shall be the forum for any lawsuits filed under or incident to this Agreement. The terms and provisions of this Agreement shall be severable, such that if a court of competent jurisdiction holds any term to be illegal, unenforceable, or in conflict with any law governing this Agreement the validity of the remaining portions shall not be affected thereby, and each and every term and condition of this Agreement shall be valid and enforced to the fullest extent and in the broadest application permitted by law
